Book Review titling “Strategy on managing construction claims based on FIDIC Conditions of Contract 1999-2010-2017”

Book Review titling “Strategy on managing construction claims based on FIDIC Conditions of Contract 1999-2010-2017” by Prof Sarwono Hardjomuljadi conducted by Pekalongan University as the step of founding the Society of Construction Law (SCL) Indonesia, to introduce and disseminate the importance of understanding the construction contract for the stakeholder of construction contract. The event was conducted on 29th September 2022 at Auditorium Adaro Building F 8th floor.

Prof Sarwono Hardjomuljadi is the member of Board of Trustee Pekalongan University, who is also Member of Board of Director of Fédération Internationale Des Ingénieurs-Conseils (FIDIC), Director for Asia of Dispute Resolution Board Foundation (DRBF), Country Representative for Indonesia of DRBF, he is one of the founder of SCL Indonesia.

In this occasion a book review panels were Prof. Dr.Ir. Sarwono Hardjomuljadi, MSc, SH, MH; Prof. Dr. Achmad Busro SH, MHum, Professor of Faculty of Law Diponegoro University; Prof. Ir. M.Agung Wibowo, MM, Msc, PhD, Dean of Faculty of Engineering, Diponegoro University; Ir. Yosef Haryono, Sp.1, Leccturer at Tarumanagara University with moderator Ir. Enni Moeliati Soetanto, MM, LLM and Dr. A.H.As’ari Taufiqurrahman, SH, MH.

Prof. Sarwono said that recently construction claims often occur in construction projects are “damages”, namely claims submitted by one party who cannot complete the responsibilities written in the construction contract. Therefore, the book he wrote explains the clauses related to the rights and obligations of the parties in the contract, as well as providing an understanding for a common view with the main aim of completing the project on time, on cost, on the right quality and not burdened by the occurrence of prolonged disputes. In construction management, where a contract has been agreed, there are often differences in the interpretation of the contract. So that it makes easier and useful for all parties, including stakeholders as contractors, lawyers, academicians. This book could be used in higher education as lecture material.

The lack of reference books for completing the solution makes the book by Prof. Sarwono is a guide for parties in dispute, because the book has been written very systematically in various aspects regarding construction. We hope that the book review activity on Strategy of Managing Contractor Claims based on Fidic Conditions of Contract 1999-2010-2017 can provide understanding and knowledge to prepare contracts and also prevent prolonged disputes. Pekalongan University in cooperation with Society of Construction Law (SCL) Indonesia has also prepared a master’s study program in construction law which will be able to provide knowledge about construction law.
